Facts

The appellants was a petitioner before Ogun State Election Petition Tribunal where he challenged the return of the 3rd respondent as the winner of the election held on 5/12/98 for the chairmanship of Odeda Local Government in which the petitioner and two others ran as candidates along with the 3rd respondent. The election was conducted under the Local Government (Basic Constitutional and Transitional Provisions) Decree No.36 of 1998, which in succeeding references would be contracted as the Election Decree.

In his petition the appellant made several allegations ranging from the 3rd respondent's failure to declare his assets before the Code of Conduct Bureau at the end of his term as a public officer to a sundry electoral offences as a disqualification for the contest. At the end of the trial the petition was dismissed on 18/2/99. This appeal is against that judgment.
